The picks dealt in this trade are in violation of the Stepien Rule. First, the Mavericks do not own their 2003 1st, so they cannot trade their 2004 1st. Also, if the Mavericks' 04 fell in the top 5, they'd then be without a pick in consecutive years, which is illegal.
